In this course, students will undertake a complete reading of the Sharh Kitab al-Hiyal from the celebrated Mabsut of the early classical Hanafi Imam, Muhammad b. Ahmad b. Abi Sahl al-Sarakhsi. In this book, al-Sarakhsi comments on a selection of legal stratagems (hiyal) transmitted from Imam Muhammad ibn al-Hasan al-Shaybani. This course offers a framing of Shariah that is essential for anyone engaging in ifta. Furthermore, the course offers an in-depth review of many chapters of Islamic law, through the presentation of problems and solutions from across the topics of law. *RECORDINGS ONLY*
This is the second course in the Imam Muhammad al-Shaybani Series (IMSS). This is a course for advanced students of Hanafi law. Through the course of the study, students will acquire a practical theory of Islamic law that will address the following questions:
What is the role of the Mufti?
What is the role of the Qadi?
How does Shariah operate in a society?
What is the ethical guide by which muftis and qadis abide?
How do guidelines of ifta fit within the two Hanafi theories of qiyas and istihsan?
